These terms are between you and Next Inc. ("Next Inc.", "we", "us") for Next Picks, a public directory of local businesses at nextcard.ai. Next Inc. is at 3600 Steeles Ave E, Markham, ON L3R 9Z7, Canada. By using the site, you agree to these terms.
Next Picks lets visitors look up local businesses and ask the on-site AI about public information. A business can be listed by submitting a public website address, or, if the site was built on NextAIsite, by leaving "Show on Next Picks" on. These terms cover that directory. They are not a subscription contract.
Browsing Next Picks, submitting a website to join, and using the AI check do not require a fee today.
If we later charge for a feature, we will show the price, currency, and what the fee covers before you confirm payment. If a feature you already use starts to require a fee, we will tell you in advance. You may decline and stop using that feature. We will not bill you for a period you did not agree to pay for. A paid feature, when one exists, will have its own payment notice. These terms stay the terms for the directory.
Listings and AI summaries are information drawn from public websites and, where an owner authorized it, from a Google Business Profile. They do not mean that Next Picks certifies a business's qualifications, licence, or quality of work. Before you hire someone or sign a contract, check the licence with the authority that issues it.
If you submit a website, you confirm that the site is public and that you are the business or you are allowed to submit it. You may also authorize a read-only look at your Google Business Profile. We read the profile and revoke that access immediately. We do not post to it or edit it.
A live NextAIsite website can appear on Next Picks without a separate join step. The owner can turn that off in Website Settings.
We may refuse a listing, send it for a person to review, or remove it. We do not list sites that ask crawlers to stay out (robots.txt or noindex), sites that are not a local business, or sites whose content is adult, gambling, payday or predatory lending, weapons, drugs, counterfeit, or a scam.
To take a listing down, change it, or delete Google Business Profile data we stored, email review@nextaisite.com. We verify that the request comes from the business.
You keep the rights in your own website content. Next Inc. keeps the rights in the Next Picks site, its design, how the directory is arranged, and how AI summaries are presented. You may not copy the site or those presentations except as the law allows.
Do not misuse the site. That includes submitting a website you have no right to submit, interfering with the service, or using it to break the law.
THE SERVICES ARE PROVIDED "AS IS." TO THE EXTENT ALLOWED BY APPLICABLE LAW, NEXT INC. DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE COMPLETE, THAT AI OUTPUT IS CORRECT, OR THAT THE SITE WILL BE AVAILABLE WITHOUT INTERRUPTION.
TO THE EXTENT ALLOWED BY APPLICABLE LAW, NEXT INC. IS NOT LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, OR BUSINESS. NEXT INC.'S TOTAL LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (1) THE FEES YOU PAID NEXT INC. FOR THE RELEVANT SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (2) TWO HUNDRED CANADIAN DOLLARS (CAD $200). THESE TERMS DO NOT LIMIT LIABILITY THAT THE LAW DOES NOT ALLOW TO BE LIMITED.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be brought in the courts of Ontario.
We may update these terms. We will post the new version on this page. If a change materially reduces what the directory does for you, or starts charging for something you already use, we will give notice as described in section 2. If you do not agree, stop using the site.
